This Equipment Loaner Agreement ("Agreement") is entered into between Dogtra Company ("Dogtra") and the customer completing this form ("Customer"). By accepting and using Dogtra loaner equipment, the Customer agrees to the following terms and conditions.

1. Loaned Equipment

Dogtra is providing the Customer with equipment on a temporary loan basis for evaluation, troubleshooting, or service-related purposes.

The loaned equipment remains the sole property of Dogtra Company at all times.

The Customer agrees to use the equipment only for its intended purpose and in accordance with any applicable product documentation, including the user manual provided with or made available by Dogtra.

2. Loan Period

The loan period begins on the date the equipment is shipped to the Customer and continues for a maximum of forty-five (45) days.

The Customer agrees to return the loaned equipment to Dogtra on or before the end of the approved loan period.

If additional time is needed, the Customer must request and receive written approval from Dogtra before the loan period expires.

3. Security Deposit and Equipment Replacement Charge

By accepting the loaned equipment, the Customer agrees to provide payment for the replacement value of the loaned equipment using the payment method provided during this agreement process.

The payment is intended to protect Dogtra's equipment while it is in the Customer's possession.

If the equipment is returned within the approved loan period, in acceptable condition, and with all required components, Dogtra will issue a refund, as applicable.

Returned equipment will be inspected by Dogtra upon receipt. Dogtra will determine whether the equipment has been returned complete and in acceptable condition, reasonable wear from proper use excepted.

If the equipment is not returned by the required return date, is lost, stolen, or returned damaged beyond normal wear, Dogtra may retain all or a portion of the payment received and apply those funds toward repair costs, missing components, or any other amounts owed under this Agreement.

4. Customer Responsibility

The Customer accepts responsibility for the loaned equipment while it is in their possession.

The Customer agrees to:

Properly operate and care for the equipment.
Protect the equipment from loss, theft, misuse, or damage.
Return the equipment in the same condition in which it was received, excluding normal wear from proper use.
Not disassemble, modify, repair, or allow any third party to repair or alter the loaned equipment.

The Customer is responsible for the cost of replacing missing items and repairing or replacing equipment damaged due to misuse, neglect, unauthorized modification, improper handling, or circumstances beyond normal wear and tear.

5. Return Requirements

The Customer agrees to return the loaned equipment by the required return date using the instructions provided by Dogtra.

All equipment, accessories, chargers, straps, antennas, and other included components must be returned.

The Customer remains responsible for the loaned equipment until it has been received and accepted by Dogtra.

Failure to return the complete loaner package may result in additional charges as outlined in this Agreement.

6. Loaner Shipping for Out-of-Warranty Service

If Dogtra determines that the Customer's equipment is outside the applicable warranty period, the Customer is responsible for all shipping charges associated with the loaner equipment, including outbound and return shipping, if applicable. These shipping charges are non-refundable and will not be reimbursed upon the return of the loaned equipment.

7. Eligibility and Shipping Restrictions

Dogtra's Equipment Loaner Program is available only to customers with shipping addresses located within the contiguous United States. Dogtra does not ship loaner equipment internationally or to U.S. territories through this program.

8. Limitation of Liability

The Customer acknowledges that the loaned equipment is provided for temporary evaluation, troubleshooting, or service-related purposes. To the fullest extent permitted by applicable law, Dogtra shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the Customer's possession or use of the loaned equipment.

Dogtra's total liability under this Agreement shall not exceed the replacement value of the loaned equipment, except where such limitation is prohibited by applicable law.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in California, and the Customer consents to the jurisdiction of those courts.

10. Agreement Acceptance

By checking the acceptance box below, the Customer confirms that they have read, understood, and agree to all terms and conditions outlined in this Equipment Loaner Agreement.

The Customer acknowledges that they are responsible for the loaned equipment until it has been received and accepted by Dogtra.

This Agreement represents the entire understanding between Dogtra and the Customer regarding the loaned equipment and supersedes all prior verbal or written discussions relating to this loan.
